Terms of service
Last updated October 8, 2026
Maxima Learning is operated by ML Education LLC, a Montana limited liability company.
These terms are an agreement between you and Maxima Learning (“Maxima,” “we,” “us”) covering your use of maximalearning.com and our tutoring service. You agree to them when you accept them at sign-up or checkout, sign them, or create an account or book a session. Our privacy policy is part of these terms and explains how we handle your information and your child’s.
Who can use Maxima
Accounts are for parents and legal guardians who are at least 18. You create the account and enroll your child, and you are responsible for your account and for your child’s use of the service. Keep your sign-in details secure, and tell us right away if you think someone else has accessed your account. Tutors work with us under a separate agreement.
The service
Maxima provides live one-on-one online math tutoring with a tutor we assign, plus practice sets, assessments, and progress reports. Every family starts with a free consultation with our founders and a free placement test. We may decline to enroll a student if we don’t think we’re the right fit. We may improve or change parts of the service over time. If a change meaningfully reduces what your plan includes, we’ll tell you in advance.
Plans and billing
- Plans are billed monthly in advance through our payment processor, Stripe.
- Your plan renews automatically each month until you cancel. There is no long-term contract.
- Each plan includes a set number of sessions per month, as described on our pricing page.
- If we change our prices, we’ll email you at least 30 days before the change affects your plan.
- If a payment fails, we may pause scheduling until it’s resolved.
Cancelling your plan
You can cancel anytime online. Email support@maximalearning.com or use the billing page in your account. If you’re planning to stop, we appreciate two weeks’ notice so we can plan your tutor’s schedule. Your plan stays active through the end of the month you’ve paid for, and sessions continue through that date. After that, your plan ends and you won’t be charged again. We don’t offer partial refunds for the remainder of a paid month. Except as required by law or described in the Maxima Guarantee, payments are non-refundable.
Scheduling, cancellations, and missed sessions
- You can cancel or reschedule a session for free up to 24 hours before it starts.
- A session cancelled with less than 24 hours’ notice, or missed without notice, counts as a used session.
- If your tutor cancels or can’t attend, we’ll reschedule the session at no cost to you.
The Maxima Guarantee
Your child will master a full grade level of new math within six months, or we’ll keep teaching for free until they do. The guarantee applies when your child:
- has been confirmed as eligible by us in writing after your consultation,
- completes the placement test before their first session,
- stays continuously enrolled on a plan,
- attends at least 90% of their scheduled sessions, and
- completes the practice sets assigned between sessions.
Six months after your child’s first session, we compare their mastery map to their placement test results. If they haven’t mastered a full grade level of new material, we continue tutoring at no charge, at the same weekly schedule, until they have. Continued tutoring is the remedy under the guarantee. It is not a cash refund.
Safety, supervision, and conduct
- You are responsible for supervising your child during sessions. For younger children, we ask that a parent or another adult be nearby. Our tutors teach online and can’t respond to an emergency where your child is.
- All contact between tutors and your child happens in live sessions on the Maxima platform or through you. Tutors will not contact your child directly by phone, text, email, or social media, and will not meet your child in person. If anyone asks otherwise, please tell us right away.
- Nothing a tutor says to your child should ever be something your child is asked to keep from you.
- Please arrange all tutoring through Maxima rather than directly with a Maxima tutor. We can only stand behind sessions that happen on our platform.
- Students, parents, and tutors are expected to be respectful toward one another.
- Please don’t record sessions or share session links. Sessions are private to the people invited. We don’t record sessions either.
- We may suspend or end the service for conduct that is abusive, unsafe, or violates these terms. If we end your plan for reasons other than a breach of these terms, we’ll refund any unused prepaid sessions.
Your child’s information
By enrolling your child, you consent, as their parent or legal guardian, to our collecting and using their information as described in our privacy policy, only to teach them and run the service. You can review or delete your child’s information, or withdraw your consent, at any time by emailing support@maximalearning.com. Withdrawing consent ends tutoring for that child.
We will never use your child’s name, image, voice, or work in marketing, or share your family’s story publicly, without your separate written permission.
Our content
Our curriculum, problems, practice sets, assessments, and platform belong to Maxima. You may use them for your child’s personal learning, but you may not copy, resell, or redistribute them. Your child’s own work belongs to your family.
Disclaimers
We work hard for every student, but outside the Maxima Guarantee we can’t promise specific results, such as grades, test scores, or placement decisions by a school. Maxima is not affiliated with any school or school district. We aim to keep the platform available, but it is provided “as is,” and there may be occasional interruptions, including from the third-party services we rely on.
Limitation of liability
To the extent the law allows, Maxima is not liable for indirect, incidental, or consequential damages, and our total liability for any claim related to the service is limited to the amount you paid us in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
Governing law and disputes
These terms are governed by the laws of Montana, except where the law of the state you live in gives you protections that can’t be waived. If something goes wrong, please email us first and give us 30 days to try to resolve it. Most concerns can be resolved quickly and informally.
If we can’t resolve it, either of us may bring the claim in small claims court, if it qualifies. Otherwise, any claim will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, by video or phone or in the county where you live, and we will pay the filing and arbitrator fees those rules assign to us. Claims may be brought only individually, not as a plaintiff or class member in any class or representative proceeding. If a court decides that this paragraph can’t be enforced for a particular claim or remedy, such as public injunctive relief, that claim or remedy will be decided in court, and the rest of this paragraph still applies. You can opt out of arbitration by emailing support@maximalearning.com within 30 days of first accepting these terms.
Changes to these terms
If we make a material change, we’ll email account holders at least 14 days before it takes effect. Continuing to use Maxima after that means you accept the updated terms.
